Acknowledgement of Risk, Waiver and Release Agreement.

 

PARTIES:

I acknowledge that I am a guest member of the proprietor of this Snap Fitness Club
(Snap) and that in consideration of Snap providing me with use of the equipment and facilities, I agree to all of the terms and conditions in this agreement and I agree to the acknowledgement of risk, waiver and release contained herein. I acknowledge that I am not permitted to use any of the equipment without supervision of a Snap employee or fitness professional (Snap Staff), that I must comply with all Snap Membership Policies, Club Rules and any directions given to me by Snap relating to my use of the equipment and facilities and the length of time I am permitted to remain at the club. The term “I" includes my heirs executors, administrators and assigns and the term "Snap” includes the agents representatives offices and directors of Snap.

 

ACKNOWLEDGEMENT OF RISK:

I acknowledge that undertaking recreational activities and the use of fitness equipment and gym facilities does involve risk of injury, whether caused by myself or another party. I agree to assume all risks of injury or illness that may result from my use the equipment and facilities provided by Snap at the Club, irrespective of how such injuries or illness arises. I release, to the fullest extent allowable at law Snap Staff, Snap and its employees managers and agents from and against all expenses, damages, costs, liabilities, claims, actions, proceedings, damages, judgements and losses of any kind arising out of, caused by, attributable to or resulting from any accident, damage loss injury or death to any person as a result of my use of the equipment or facilities or as a result of my presence as a guest member at the Club.

 

INDEMNITY:

I indemnify Snap and Snap Staff against and from all expenses, damages, costs, liabilities, claims, actions, proceedings, damages, judgements and losses of any kind whatsoever that Snap incurs arising out of, caused by, attributable to or resulting from any accident, damage, loss, damage to property, injury or death to any person caused by me at or in the Club or in the vicinity of the Club.

 

EQUIPMENT: I understand and acknowledge that Snap purchases or leases the equipment from a third party and does not manufacture any of the fitness or other equipment used in the Club. I understand and acknowledge that Snap is providing recreational services and may not be held liable for defective products or equipment. I acknowledge that I must use the equipment only in the manner specified by Snap or by the equipment manufacturer.

 

PHYSICAL CONDITION AND NO MEDICAL ADVICE:

I represent and warrant that I am in good physical condition and have no medical
reason or Impairment that might prevent me from using the equipment at the Club.
I warrant that if I have any medical condition or physical injury that could be of any

concern in undertaking recreational activities, I have obtained medical advice and
approval prior to my use of the equipment or facilities at this club. I acknowledge that Snap did not give me medical advice before I used the equipment, and cannot give me any medical advice after I use the equipment. If I have any health or medical concerns now or after I join as a member of the club, I acknowledge that I must discuss them with my doctor before using the equipment.

 

LIMITED USE:

If I know or should know that I have any injury or problem that may prevent me from
using any or all of Snaps equipment, I sign this agreement on the basis that my guest
membership is limited accordingly.

 

LIABILITY FOR PERSONAL PROPERTY:

I acknowledge that Snap is not liable to me for any personal property that is damaged, lost, stolen while on or around the Club including, but not limited to, a vehicle or its contents or any property left in an open locker. If I cause damage to the Club or any equipment I am liable to Snap for its cost of repair or replacement.

 

ENTIRE AGREEMENT AND ENFORCEMENT:

I acknowledge that neither Snap nor any other party has made any representations
warranties or promises upon which I have relied when entering this agreement. This
document contains the entire agreement between myself and Snap and replaces any oral or other written agreement. Any manual or hand written changes to this agreement are not valid. If a court declares any part of this agreement invalid, it will not invalidate the remaining parts, which continue unaffected. If Snap does not enforce any rights in this agreement for any reason, Snap does not waive its right to enforce it later.

 

VIDEO SURVEILLANCE:

I acknowledge that for security purposes, Snap uses video sun/eillance equipment to
monitor the Club on a 24 hour basis. By signing this agreement I acknowledge that by accessing this facility I will be subject to video surveillance and recording. Video
surveillance is limited to the floor area and outside entry into the Club only, and does
extend to the bathrooms or client screening rooms.
